Công ty bảo vệ an toàn và quản lý tách biệt tài sản của từng Quỹ, của Công ty; Công ty đảm bảo tách biệt về tổ chức, nhân sự, và hoạt động giữa hoạt động quản lý quỹ, hoạt động tư vấn tài chính và đầu tư chứng khoán; e. Đối với những giao dịch của Quỹ do Công ty thực hiện trong đó có sự tham gia của người liên quan của Công ty, phải đảm bảo sự công bằng và không làm tổn hại đến quyền lợi của Quỹ; thông báo đầy đủ thông tin liên quan đến giao dịch đó cho Ban đại diện quỹ, Ủy ban Chứng khoán Nhà nước và thông báo công khai cho người đầu tư; f. Bảo đảm việc ủy quyền trách nhiệm cho bên thứ ba và sự thay đổi tổ chức, quản lý của Công ty không gây ảnh hưởng bất lợi đến quyền lợi của Quỹ; g. Công ty chịu trách nhiệm đền bù các tổn thất của Quỹ do Công ty không thực đúng nghĩa vụ của mình; h. Tất cả các giao dịch chứng khoán cá nhân của những người quản lý và nhân viên của Công ty đều phải được báo cáo và quản lý tập trung tại Công ty dưới sự giám sát của bộ phận kiểm soát nội bộ; i. Khi Công ty giao dịch mua, bán các tài sản cho Quỹ thì Giám đốc, Phó Giám đốc của Công ty, người điều hành quỹ không được nhận bất kỳ một lợi ích nào cho Công ty hoặc cho chính mình hoặc cho một người thứ ba, ngoài khoản phí và thưởng quy định trong Điều lệ quỹ; j. Công ty có nghĩa vụ thực hiện việc xác định giá trị tài sản ròng của Quỹ theo quy định của pháp luật; k. Trong trường hợp ngân hàng giám sát phát hiện và thông báo cho Công ty biết giao dịch không phù hợp với quy định của pháp luật, Điều lệ quỹ hoặc vượt quá thẩm quyền của Công ty, thì Công ty sẽ hủy bỏ giao dịch đó hoặc thực hiện mua hoặc bán tài sản của Quỹ nhằm phục hồi tài sản quỹ như trước khi có giao dịch. Mọi chi phí phát sinh liên quan đến các giao dịch này do Công ty chịu. l. Thực hiện nghiêm chỉnh Quy chế về tổ chức và hoạt động của quỹ đầu tư chứng khoán và công ty quản lý quỹ do Bộ tài chính ban hành; m. For transactions of funds realized by Company with the participation of Company’s related persons, fairness must be ensured and interests of funds must not be compromised; information related to that transaction shall be communicated to the Funds representative committee, the State Securities Committee and communicated publicly to investors; f. Ensure that the authorization of liability to the third party and the organizational and management changes of Company do not cause an adverse impact on the interests of funds; g. Company is liable for compensation for damages to funds due to Company’s non-fulfilment of its obligations. h. All personal securities tradings of managers and employees of Company must be reported and centrally managed at Company under the supervision of internal conrol board; i. When Company purchase or sell assets for funds, the Director, Deputy Director of Company, and the manager of funds must not accept, in addition to the fees and bonuses stipulated in the regulations on funds, any benefits for Company or for themselves or for a third person; j. Company is responsible for implementing the determination of the net asset value of funds pursuant to provisions of the law; k. In the case where the custodian bank discovers and advises Company that its transaction does not conform to provisions of the law, regulations of funds or exceeds Company’s authority, Company shall cancel that transaction or conduct a purchase or sale of fund assets in order to restore fund assets to its status before that transaction. All incurred expenses related to this transaction shall be borne by Company; l. Strictly implement the statutes on the organization and operation of securities investment funds and funds management companies promulgated by Ministry of Finance; m. Khi áp dụng điểm a khoản 4 Điều 139 Bộ luật hình sự về tội lừa đảo chiếm đoạt tài sản cần chú ý: 2.1. Trong trường hợp không có tình tiết tăng nặng trách nhiệm hình sự (sau đây gọi tắt là tình tiết tăng nặng) và không có tình tiết giảm nhẹ trách nhiệm hình sự (sau đây gọi tắt là tình tiết giảm nhẹ) hoặc vừa có tình tiết tăng nặng, vừa có tình tiết giảm nhẹ, nhưng đánh giá tính chất tăng nặng và tính chất giảm nhẹ tương đương nhau, thì xử phạt người phạm tội mức án tương ứng với giá trị tài sản bị chiếm đoạt như sau: a. Xử phạt tù từ 12 năm đến 20 năm nếu tài sản bị chiếm đoạt có giá trị từ năm trăm triệu đồng đến dưới một tỷ năm trăm triệu đồng. b. Xử phạt tù chung thân nếu tài sản bị chiếm đoạt có giá trị từ một tỷ năm trăm triệu đồng đến dưới bốn tỷ năm trăm triệu đồng; c. Xử phạt tử hình nếu tài sản bị chiếm đoạt có giá trị từ bốn tỷ năm trăm triệu đồng trở lên. 2.2. Trong trường hợp có nhiều tình tiết giảm nhẹ mà không có tình tiết tăng nặng hoặc có ít tình tiết tăng nặng hơn, đồng thời đánh giá tính chất giảm nhẹ và tính chất tăng nặng xét thấy có thể giảm nhẹ trách nhiệm hình sự cho người phạm tội, thì có thể xử phạt người phạm tội mức án nhẹ hơn mức án được hướng dẫn tại tiểu mục 2.1 Mục 2 này như sau: a. Xử phạt tù từ bảy năm đến dưới mười hai năm nếu tài sản bị chiếm đoạt có giá trị từ năm trăm triệu đồng đến dưới một tỷ năm trăm triệu đồng (trường hợp này phải có ít nhất hai tình tiết giảm nhẹ quy định tại khoản 1 Điều 46 Bộ luật hình sự); b. Xử phạt tù từ mười hai năm đến hai mươi năm nếu tài sản bị chiếm đoạt có giá trị từ một tỷ năm trăm triêụ đồng đến dưới bốn tỷ năm trăm triệu đồng; c. Xử phạt tù chung thân nếu tài sản bị chiếm đoạt có giá trị từ bốn tỷ năm trăm triệu đồng trở lên. 2.3. Trong trường hợp có nhiều tình tiết tăng nặng mà không có tình tiết giảm nhẹ hoặc có ít tình tiết giảm nhẹ hơn, đồng thời đánh giá tính chất tăng nặng và tính chất giảm nhẹ xét thấy cần tăng nặng trách nhiệm hình sự đối với người phạm tội, thì có thể xử phạt người phạm tội mức án nặng hơn mức án được hướng dẫn tại tiểu mục 2.1 Mục 2 này như sau: a. Xử phạt tù chung thân nếu tài sản bị chiếm đoạt có giá trị từ năm trăm triệu đồng đến dưới một tỷ năm trăm triệu đồng; b. Xử phạt tử hình nếu tài sản bị chiếm đoạt có giá trị từ một tỷ năm trăm triệu đồng trở lên. 2.4. Trong trường hợp theo hướng dẫn tại các tiểu mục 2.1 và 2.3 Mục 2 này người phạm tội phải bị xử phạt tử hình, nhưng người phạm tội đã bồi thường được một phần đáng kể giá trị tài sản bị chiếm đoạt (hoặc người thân thích, ruột thịt... của người phạm tội đã bồi thường thay cho người phạm tội), thì có thể không xử phạt tử hình người phạm tội và tuỳ vào số tiền đã bồi thường được mà có thể xử phạt người phạm tội tù chung thân hoặc tù có thời hạn. Được coi là đã bồi thường được một phần đáng kể giá trị tài sản bị chiếm đoạt nếu: a. Đã bồi thường được ít nhất một phần hai giá trị tài sản bị chiếm đoạt; b. Đã bồi thường được từ một phần ba đến dưới một phần hai giá trị tài sản bị chiếm đoạt, nếu có căn cứ chứng minh rằng người phạm tội (hoặc người thân thích, ruột thịt... của người phạm tội) đã thực hiện mọi biện pháp để bồi thường giá trị tài sản bị chiếm đoạt (đã bán hết nhà ở, tài sản có giá trị; cố gắng vay, mượn... đến mức tối đa). 3. Khi áp dụng khoản 4 Điều 193 Bộ luật Hình sự về tội sản xuất trái phép chất ma tuý và khoản 4 Điều 194 Bộ luật Hình sự về tội tàng trữ, vận chuyển, mua bán trái phép hoặc chiếm đoạt chất ma tuý cần chú ý; 3.1. Trong trường hợp không có tình tiết tăng nặng và không có tình tiết giảm nhẹ hoặc vừa có tình tiết tăng nặng, vừa có tình tiết giảm nhẹ, nhưng đánh giá tính chất tăng nặng và tính chất giảm nhẹ tương đương nhau, thì xử phạt người phạm tội mức án tương ứng với trọng lượng chất ma tuý như sau: a. Xử phạt hai mươi năm tù nếu: - Nhựa thuốc phiện, nhựa cần sa hoặc cao côca có trọng lượng từ 5 kilôgam đến dưới mười kilôgam; - Hêrôin hoặc côcain có trọng lượng từ một trăm gam đến dưới ba trăm gam; - Lá, hoa, quả cây cần sa hoặc lá cây coca có trọng lượng từ bảy mười lăm kilôgam đến dưới hai trăm kilôgam (đối với Điều 194 Bộ luật Hình sự); - Quả thuốc phiện khô có trọng lượng từ sáu trăm kilôgam đến dưới một nghìn năm trăm kilôgam (đối với Điều 194 Bộ luật Hình sự): - Quả thuốc phiện tươi có trọng lượng từ một trăm năm mươi kilôgam đến dưới bốn trăm năm mươi kilôgam (đối với Điều 194 Bộ luật Hình sự); - Các chất ma tuý khác ở thể rắn có trọng lượng từ ba trăm gam đến dưới chín trăm gam; - Các chất ma tuý khác ở thể lỏng từ bảy trăm năm mươi mililít đến dưới hai nghìn mililít; - Có từ hai chất ma tuý trở lên mà tổng số lượng của các chất đó tương đương với số lượng của một trong các chất ma tuý thuộc điểm a này theo cách tính được hướng dẫn tại tiểu mục 3.2 Mục 3 này. b. Xử phạt tù chung thân nếu: - Nhựa thuốc phiện, nhựa cần sa hoặc cao côca có trọng lượng từ mười kilôgam đến dưới hai mươi kilôgam; - Hêrôin hoặc côcain có trọng lượng từ ba trăm gam đến dưới sáu trăm gam; - Lá, hoa, quả cây cần sa hoặc lá cây coca có trọng lượng từ hai trăm kilôgam đến dưới sáu trăm kilôgam (đối với Điều 194 BLHS); - Quả thuốc phiện khô có trọng lượng từ một nghìn năm trăm kilogam đến dưới bốn nghìn năm trăm kilôgam (đối với Điều 194 BLHS); - Quả thuốc phiện tươi có trọng lượng từ bốn trăm năm mươi kilôgam đến dưới một nghìn hai trăm kilôgam (đối với Điều 194 Bộ luật hình sự); - Các chất ma tuý khác ở thể rắn có trọng lượng từ chín trăm gam đến dưới hai nghìn năm trăm gam; - Các chất ma tuý khác ở thể lỏng từ hai nghìn mililít đến dưới năm nghìn mililít; - Có từ hai chất ma tuý trở lên mà tổng số lượng của các chất đó tương đương với số lượng của một trong các chất ma tuý thuộc điểm b này theo cách tính được hướng dẫn tại tiểu mục 3.2 Mục 3 này. c. Xử phạt tử hình nếu: - Nhựa thuốc phiện, nhựa cần sa hoặc cao côca có trọng lượng từ hai mươi kilôgam trở lên; - Hêrôin hoặc côcain có trọng lượng từ sáu trăm gam trở lên; - Lá, hoa, quả cây cần sa hoặc lá cây côca có trọng lượng từ sáu trăm kilôgam trở lên (đối với Điều 194 Bộ luật Hình sự); - Quả thuốc phiện khô có trọng lượng từ bốn nghìn năm trăm kilôgam trở lên (đối với Điều 194 BLHS); - Quả thuốc phiện tươi có trọng lượng từ một nghìn hai trăm kilôgam trở lên (đối với Điều 194 Bộ luật Hình sự); - Các chất ma tuý khác ở thể rắn có trọng lượng từ hai nghìn năm trăm gam trở lên; - Các chất ma tuý khác ở thể lỏng từ năm nghìn mililít trở lên; - Có từ hai chất ma tuý trở lên mà tổng số lượng của các chất đó tương đương với số lượng của một trong các chất ma tuý thuộc điểm c này theo cách tính được hướng dẫn tại tiểu mục 3.2 Mục 3 này. 3.2. Tình tiết "có từ hai chất ma tuý trở lên mà tổng số lượng của các chất đó tương đương với số lượng chất ma tuý quy định tại một trong các điểm từ..." quy định tại điểm đ khoản 4 Điều 193 và điểm h khoản 4 Điều 194 BLHS được tính như sau: a. Trường hợp thứ nhất. Nếu các chất ma tuý đó đều được quy định trong cùng một điểm của khoản 4 Điều 193 hoặc của khoản 4 Điều 194, thì cộng trọng lượng các chất ma tuý đó lại với nhau và so sánh với trọng lượng được hướng dẫn tại tiểu mục 3.1 Mục 3 này để xem xét người phạm tội phải bị xử phạt mức hình phạt nào. Ví dụ 1: Một người sản xuất 9 kilôgam nhựa thuốc phiện và 17 kilôgam nhựa cần sa. Do nhựa thuốc phiện và nhựa cần sa đều được quy định trong cùng điểm a Khoản 4 Điều 193, cho nên cần cộng trọng lượng nhựa thuốc phiện và nhựa cần sa lại với nhau bằng 26 kilôgam (9 kg 17 kg = 26 kg). Đối chiếu với trọng lượng được hướng dẫn tại tiểu mục 3.1 Mục 3 này thì phải áp dụng điểm đ khoản 4 Điều 193 để xử phạt người phạm tội mức án tử hình. Ví dụ 2: Một người mua bán 115 gam Hêrôin và 125 gam Côcain. Do Hêrôin và Côcain đều được quy định trong cùng điểm b khoản 4 Điều 194, cho nên cộng trọng lượng Hêrôin và Côcain lại với nhau bằng 240 gam (115 gam 125 gam = 240 gam). Đối chiếu với trọng lượng được hướng dẫn tại tiểu mục 3.1 Mục 3 này thì phải áp dụng điểm b khoản 4 Điều 194 để xử phạt người phạm tội mức án 20 năm tù. b. Trường hợp thứ hai Nếu các chất ma tuý đó được quy định tại các điểm khác nhau của khoản 2, khoản 3, khoản 4 Điều 193 hoặc tại các điểm khác nhau của khoản 2, khoản 3, khoản 4 Điều 194, thì cách tính tổng số lượng của các chất ma tuý này tương đương với số lượng của một trong các chất ma tuý quy định tại khoản 4 Điều 193 hoặc tại khoản 4 Điều 194 được tiến hành theo trình tự sau đây: b.1. Lần lượt lấy làm chuẩn từng chất ma tuý trong số các chất ma tuý mà người phạm tội đã sản xuất, tàng trữ, vận chuyển, mua bán trái phép hoặc chiếm đoạt. Tính trọng lượng (số lượng) của các chất ma tuý còn lại trong số các chất ma tuý mà người phạm tội đã sản xuất, tàng trữ, vận chuyển, mua bán trái phép hoặc chiếm đoạt tương ứng với bao nhiêu kilôgam (gam) hoặc mililít của chất ma tuý đã lấy theo tỷ lệ trọng lượng (số lượng) tối thiểu của các chất ma tuý còn lại với trọng lượng (số lượng) tối thiểu của chất ma tuý đã lấy làm chuẩn quy định tại khoản 4 Điều 193 hoặc khoản 4 Điều 194 (xem ví dụ dưới đây). b.2. Cộng trọng lượng (số lượng) của các chất ma tuý đã tính được tương đương với trọng lượng (số lượng thực có của chất ma tuý đã lấy làm chuẩn thì được tổng số lượng của các chất ma tuý người phạm tội đã sản xuất, tàng trữ, vận chuyển, mua bán trái phép hoặc chiếm đoạt (tính tương đương với chất ma tuý đã lấy làm chuẩn) (xem ví dụ dưới đây). b.3. So sánh các kết quả tính tổng số lượng của các chất ma tuý mà người phạm tội đã sản xuất, tàng trữ, vận chuyển, mua bán trái phép hoặc chiếm đoạt tương đương (theo từng chất ma tuý đã lấy làm chuẩn) với nhau và với hướng dẫn tại tiểu mục 3.1 Mục 3 này. Nếu tổng số lượng của các chất ma tuý tương đương theo chất ma tuý nào mà có lợi cho người phạm tội khi quyết định hình phạt, thì lấy tổng số lượng đó (xem ví dụ dưới đây). Ví dụ: Một người mua bán 4 kilôgam thuốc phiện, 90 gam hêrôin và 150 gam chất ma tuý khác ở thể rắn. Cách tính tổng số lượng của các chất ma tuý này như sau: - Thứ nhất: lấy thuốc phiện làm chuẩn để tính 90 gam hêrôin và 150 gam chất ma tuý khác ở thể rắn tương đương với bao nhiêu kilôgam thuốc phiện (tính theo tỷ lệ trọng lượng tối thiểu của thuốc phiện và hêrôin, của thuốc phiện và chất ma tuý khác ở thể rắn quy định tại khoản 4 Điều 194); cụ thể là: * Đối với Hêrôin: 100 gam Hêrôin tương đương với 5 kilôgam thuốc phiện. 90 gam Hêrôin tương đương với X kilôgam thuốc phiện. 90 grams x 5 kilograms X = -------------------------- = 4.5 kilôgam thuốc phiện 100 grams X 150 gam chất ma tuý khác ở thể rắn tương đương với Y kilôgam thuốc phiện. Y = 150 gam x 5 kilôgam 300 gam = 2,5 kilôgam thuốc phiện Cộng trọng lượng của Hêrôin và chất ma tuý khác ở thể rắn vừa tính được tương đương với trọng lượng thuốc phiện (X và Y) với trọng lượng thuốc phiện thực có là: 4,5 kilôgam 2,5 kilôgam 4 kilôgam = 11 kilôgam. Như vậy, trong trường hợp này tổng số lượng của thuốc phiện, Hêrôin và chất ma tuý khác ở thể rắn (các chất ma tuý mà người phạm tội đã mua bán trái phép) tương đương với 11 kilôgam thuốc phiện (1). - Thứ hai: lấy Hêrôin làm chuẩn để tính 4 kg thuốc phiện và 150 gam chất ma tuý khác ở thể rắn tương đương với bao nhiêu gam Hêrôin (tính theo tỷ lệ trọng lượng tối thiểu của Hêrôin và thuốc phiện, của Hêrôin và chất ma tuý khác ở thể rắn quy định tại khoản 4 Điều 194) cụ thể là: * Đối với thuốc phiện: 5 kilôgam thuốc phiện tương đương với 100 gam Hêrôin 4 kilôgam thuốc phiện tương đương với X gam Hêrôin X = 4 kilôgam x 100 gam 5 kilôgam = 80 gam hêrôin * Đối với các chất ma tuý khác ở thể rắn: 300 gam chất ma tuý khác ở thể rắn tương đương với 100 gam Hêrôin 150 gam chất ma tuý khác ở thể rắn tương đương với Y gam Hêrôin Y = 150 gam x 100 gam 300 gam = 50 gam Hêrôin Cộng trọng lượng của thuốc phiện và chất ma tuý khác ở thể rắn vừa tính được tương đương với trọng lượng Hêrôin (X và Y) với trọng lượng Hêrôin thực có là: 80 gam 50 gam 90 gam = 220 gam Như vậy, trong trường hợp này tổng số lượng của thuốc phiện, Hêrôin và chất ma tuý khác ở thể rắn (các chất ma tuý mà người phạm tội đã mua bán trái phép) tương đương với 220 gam Hêrôin (2). - Thứ ba: lấy chất ma tuý khác ở thể rắn làm chuẩn để tính 4 kg thuốc phiện và 90 gam Hêrôin tương đương với bao nhiêu gam chất ma tuý khác ở thể rắn (tính theo tỷ lệ trọng lượng tối thiểu của chất ma tuý khác ở thể rắn và thuốc phiện, của chất ma tuý khác ở thể rắn và Hêrôin quy định tại khoản 4 Điều 194); cụ thể là: * Đối với thuốc phiện: 5 kilôgam thuốc phiện tương đương với 300 gam chất ma tuý khác ở thể rắn. 4 kilôgam thuốc phiện tương đương với X gam chất ma tuý khác ở thể rắn. X = 4 kilôgam x 300 gam 5 kilôgam = 240 gam chất ma tuý khác ở thể rắn * Đối với Hêrôin: 100 gam Hêrôin tương đương với 300 gam chất ma tuý khác ở thể rắn. 90 gam Hêrôin tương đương với Y gam chất ma tuý khác ở thể rắn. Y = 90 gam x 300 gam 100 gam = 270 gam chất ma tuý khác ở thể rắn Cộng trọng lượng của thuốc phiện và Hêrôin vừa tính được tương đương với trọng lượng chất ma tuý khác ở thể rắn (X và Y) với trọng lượng chất ma tuý khác ở thể rắn thực có là: 240 gam 270 gam 150 gam = 660 gam Như vậy, trong trường hợp này tổng số lượng thuốc phiện, Hêrôin và chất ma tuý khác ở thể rắn (các chất ma tuý mà người phạm tội đã mua bán trái phép) tương đương với 660 gam chất ma tuý khác ở thể rắn (3). - So sánh các kết quả xác định tổng số lượng của các chất ma tuý tương đương (theo từng chất ma tuý đã lấy làm chuẩn), tức là so sánh các kết quả (1), (2), (3) với nhau và với hướng dẫn tại tiểu mục 3.1 Mục 3 này cho thấy: * Nếu lấy tổng số lượng của các chất ma tuý tương đương với trọng lượng thuốc phiện (11kg) thì áp dụng điểm h khoản 4 Điều 194 để xử phạt người phạm tội tù chung thân (nếu không thuộc các trường hợp được hướng dẫn tại tiểu mục 3.3 và 3.4 Mục 3 này). * Nếu lấy tổng số lượng của các chất ma tuý tương đương với trọng lượng Hêrôin (220 gam) hoặc với trọng lượng chất ma tuý khác ở thể rắn (660 gam) thì áp dụng điểm h khoản 4 Điều 194 để xử phạt người phạm tội hai mươi năm tù (nếu không thuộc các trường hợp được hướng dẫn tại tiểu mục 3.3 và 3.4 Mục 3 này). Kết quả so sánh trên đây cho thấy nếu lấy tổng số lượng của các chất ma tuý mà người phạm tội đã mua bán trái phép tương đương với trọng lượng Hêrôin hoặc chất ma tuý khác ở thể rắn thì đều có lợi hơn cho người phạm tội; do đó, trong ví dụ này có thể lấy tổng số lượng của các chất ma tuý tương đương với trọng lượng Hêrôin hoặc tổng số lượng của các chất ma tuý tương đương với trọng lượng chất ma tuý khác ở thể rắn để xét xử đối với bị cáo. 3.3. Trong trường hợp có nhiều tình tiết giảm nhẹ mà không có tình tiết tăng nặng hoặc có ít tình tiết tăng nặng hơn, đồng thời đánh giá tính chất giảm nhẹ và tính chất tăng nặng xét thấy có thể giảm nhẹ trách nhiệm hình sự cho người phạm tội, thì có thể xử phạt người phạm tội mức án nhẹ hơn mức án được hướng dẫn tại tiểu mục 3.1 Mục 3 này như sau: a. Xử phạt tù từ mười lăm năm đến dưới hai mươi năm nếu trọng lượng chất ma tuý thuộc điểm a tiểu mục 3.1 Mục 3 này (trường hợp này phải có ít nhất hai tình tiết giảm nhẹ quy định tại khoản 1 Điều 46 BLHS); b. Xử phạt hai mươi năm tù nếu trọng lượng chất ma tuý thuộc điểm b tiểu mục 3.1 Mục 3 này; c. Xử phạt tù chung thân nếu trọng lượng chất ma tuý thuộc điểm c tiểu mục 3.1 Mục 3 này. 3.4. Trong trường hợp có nhiều tình tiết tăng nặng mà không có tình tiết giảm nhẹ hoặc có ít tình tiết giảm nhẹ hơn, đồng thời đánh giá tính chất tăng nặng và tính chất giảm nhẹ xét thấy cần tăng nặng trách nhiệm hình sự đối với người phạm tội, thì có thể xử phạt người phạm tội mức án nặng hơn mức án được hướng dẫn tại tiểu mục 3.1 Mục 3 này như sau: a. Xử phạt tù chung thân nếu trọng lượng chất ma tuý thuộc điểm a tiểu mục 3.1 Mục 3 này (trường hợp này phải có ít nhất hai tình tiết giảm nhẹ quy định tại khoản 1 Điều 46 BLHS); b. Xử phạt tử hình nếu trọng lượng chất ma tuý thuộc điểm b tiểu mục 3.1 Mục 3 này. 3.5. Trong trường hợp theo hướng dẫn tại các tiểu mục 3.1 và 3.4 Mục 3 này người phạm tội phải bị xử phạt tử hình, nhưng nếu người phạm tội chỉ là người giúp sức, do nể nang tình cảm, bị cưỡng bức hoặc vì hám lợi bất thời... mà tàng trữ, vận chuyển chất ma tuý hộ thì có thể không xử phạt tử hình người phạm tội và tuỳ từng trường hợp cụ thể mà có thể xử phạt người phạm tội tù chung thân hoặc tù có thời hạn. 4. Khi áp dụng điểm a khoản 4 Điều 278 BLHS về tội tham ô tài sản cần chú ý: 4.1. Trong trường hợp không có tình tiết tăng nặng và không có tình tiết giảm nhẹ hoặc vừa có tình tiết tăng nặng, vừa có tình tiết giảm nhẹ, nhưng đánh giá tính chất tăng nặng và tính chất giảm nhẹ tương đương nhau thì xử phạt người phạm tội mức án tương ứng với giá trị tài sản bị chiếm đoạt như sau: a. Xử phạt hai mươi năm tù nếu tài sản bị chiếm đoạt có giá trị từ năm trăm triệu đồng đến dưới một tỷ; b. Xử phạt tù chung thân nếu tài sản bị chiếm đoạt có giá trị từ một tỷ đồng đến dưới ba tỷ đồng; c. Xử phạt tử hình nếu tài sản bị chiếm đoạt có giá trị từ ba tỷ đồng trở lên. 4.2. Trong trường hợp có nhiều tình tiết giảm nhẹ mà không có tình tiết tăng nặng hoặc có ít tình tiết tăng nặng hơn, đồng thời đánh giá tính chất giảm nhẹ và tính chất tăng nặng xét thấy có thể giảm nhẹ trách nhiệm hình sự cho người phạm tội, thì có thể xử phạt người phạm tội mức án nhẹ hơn mức án được hướng dẫn tại tiểu mục 4.1 Mục 4 này như sau: a. Xử phạt tù từ mười lăm năm đến dưới hai mươi năm nếu tài sản bị chiếm đoạt có giá trị từ năm trăm triệu đồng đến dưới một tỷ đồng (trường hợp này phải có ít nhất hai tình tiết giảm nhẹ quy định tại khoản 1 Điều 46 BLHS); b. Xử phạt hai mươi năm tù nếu tài sản bị chiếm đoạt có giá trị từ một tỷ đồng đến dưới ba tỷ đồng; c. Xử phạt tù chung thân nếu tài sản bị chiếm đoạt có giá trị từ ba tỷ đồng trở lên. 4.3. Trong trường hợp có nhiều tình tiết tăng nặng mà không có tình tiết giảm nhẹ hoặc có ít tình tiết giảm nhẹ hơn, đồng thời đánh giá tính chất tăng nặng và tính chất giảm nhẹ xét thấy cần tăng nặng trách nhiệm hình sự đối với người phạm tội, thì có thể xử phạt người phạm tội mức án nặng hơn mức án được hướng dẫn tại tiểu mục 4.1 Mục 4 này như sau: a. Xử phạt tù chung thân nếu tài sản bị chiếm đoạt có giá trị từ năm trăm triệu đồng đến dưới một tỷ đồng; b. Xử phạt tử hình nếu tài sản bị chiếm đoạt có giá trị từ một tỷ đồng trở lên. 4.4. Trong trường hợp theo hướng dẫn tại các tiểu mục 4.1 và 4.3 Mục 4 này thì người phạm tội phải bị xử phạt tử hình, nhưng người phạm tội đã bồi thường được một phần đáng kể giá trị tài sản bị chiếm đoạt (hoặc người thân thích, ruột thịt... của người phạm tội đã bồi thường thay cho người phạm tội) thì có thể không xử phạt tử hình người phạm tội và tuỳ vào số tiền đã bồi thường được mà có thể xử phạt người phạm tội tù chung thân hoặc tù có thời hạn. Được coi là đã bồi thường được một phần đáng kể giá trị tài sản bị chiếm đoạt nếu: a. Đã bồi thường được ít nhất một phần hai giá trị tài sản bị chiếm đoạt; b. Đã bồi thường được từ một phần ba đến dưới một phần hai giá trị tài sản bị chiếm đoạt, nếu có căn cứ chứng minh rằng người phạm tội (hoặc người thân thích, ruột thịt... của người phạm tội) đã thực hiện mọi biện pháp để bồi thường giá trị tài sản bị chiếm đoạt (đã bán hết nhà ở, tài sản có giá trị; cố gắng vay, mượn... đến mức tối đa). 5. Khi áp dụng điểm a khoản 4 Điều 279 BLHS về tội nhận hối lộ và điểm a khoản 4 Điều 289 BLHS về tội đưa hối lộ cần chú ý: 5.1. Trong trường hợp không có tình tiết tăng nặng và không có tình tiết giảm nhẹ hoặc vừa có tình tiết tăng nặng, vừa có tình tiết giảm nhẹ, nhưng đánh giá tính chất tăng nặng và tính chất giảm nhẹ tương đương nhau, thì xử phạt người phạm tội mức án tương ứng với của hối lộ như sau: a. Xử phạt hai mươi năm tù nếu của hối lộ có giá trị từ ba trăm triệu đồng đến dưới tám trăm triệu đồng; b. Xử phạt tù chung thân nếu của hối lộ có giá trị từ tám trăm triệu đồng đến dưới hai tỷ đồng. c. Xử phạt tử hình nếu của hối lộ có giá trị từ hai tỷ đồng trở lên. 5.2. Trong trường hợp có nhiều tình tiết giảm nhẹ mà không có tình tiết tăng nặng hoặc có ít tình tiết tăng nặng hơn, đồng thời đánh giá tính chất giảm nhẹ và tính chất tăng nặng xét thấy có thể giảm nhẹ trách nhiệm hình sự cho người phạm tội, thì có thể xử phạt người phạm tội mức án nhẹ hơn mức án được hướng dẫn tại tiểu mục 5.1 Mục 5 này như sau: a. Xử phạt tù từ mười lăm năm (đối với tội nhận hối lộ) hoặc từ mười ba năm (đối với tội đưa hối lộ) đến dưới hai mươi năm nếu của hối lộ có giá trị từ ba trăm triệu đồng đến dưới tám trăm triệu đồng (trường hợp này phải có ít nhất hai tình tiết giảm nhẹ quy định tại khoản 1 Điều 46 BLHS); b. Xử phạt hai mươi năm tù nếu của hối lộ có giá trị từ tám trăm triệu đồng đến dưới hai tỷ đồng; c. Xử phạt tù chung thân nếu của hối lộ có giá trị từ hai tỷ đồng trở lên. 5.3. Trong trường hợp có nhiều tình tiết tăng nặng mà không có tình tiết giảm nhẹ hoặc có ít tình tiết giảm nhẹ hơn, đồng thời đánh giá tính chất tăng nặng và tính chất giảm nhẹ xét thấy cần tăng nặng trách nhiệm hình sự đối với người phạm tội, thì có thể xử phạt người phạm tội mức án nặng hơn mức án được hướng dẫn tại tiểu mục 5.1 Mục 5 này như sau: a. Xử phạt tù chung thân nếu của hối lộ có giá trị từ ba trăm triệu đồng đến dưới tám trăm triệu đồng; b. Xử phạt tử hình nếu của hối lộ có giá trị từ tám trăm triệu đồng trở lên. 5.4. Trong trường hợp theo hướng dẫn tại các tiểu mục 5.1 và 5.3 Mục 5 này thì người phạm tội nhận hối lộ phải bị xử phạt tử hình, nhưng người phạm tội nhận hối lộ đã nộp lại một phần đáng kể giá trị của hối lộ (hoặc người thân thích, ruột thịt... của người phạm tội đã nộp thay cho người phạm tội), thì có thể không xử phạt tử hình người phạm tội và tuỳ vào giá trị của hối lộ nộp lại mà có thể xử phạt người phạm tội tù chung thân hoặc tù có thời hạn. Được coi là đã nộp lại một phần đáng kể giá trị của hối lộ nếu: a. Giá trị của hối lộ đã nộp lại phải được ít nhất một phần hai giá trị của hối lộ đã nhận; b. Giá trị của hối lộ đã nộp lại phải được từ một phần ba đến dưới một phần hai giá trị của hối lộ đã nhận, nếu có căn cứ chứng minh rằng người phạm tội (hoặc người thân thích, ruột thịt... của người phạm tôi) đã thực hiện mọi biện pháp để nộp lại giá trị của hối lộ đã nhận (đã bán hết nhà ở, tài sản có giá trị; cố gắng vay, mượn... đến mức tối đa). 5.5. Trong trường hợp theo hướng dẫn tại các tiểu mục 5.1 và 5.3 Mục 5 này thì người phạm tội đưa hối lộ phải bị xử phạt tử hình, nhưng người đưa hối lộ bị ép buộc hoặc không bị ép buộc mà chủ động khai báo trước khi bị phát giác thì được xử lý theo quy định tại khoản 6 Điều 289 BLHS. 6. Cần chú ý là trường hợp được hướng dẫn tại Mục 2 Nghị quyết này là trường hợp không gây hậu quả đặc biệt nghiêm trọng; các trường hợp được hướng dẫn tại các mục 4 và 5 Nghị quyết này là các trường hợp không gây hậu quả đặc biệt nghiêm trọng khác. Trong trường hợp gây hậu quả đặc biệt nghiêm trọng (đối với tội lừa đảo chiếm đoạt tài sản) hoặc trong trường hợp gây hậu quả đặc biệt nghiêm trọng khác (đối với tội tham ô, tội nhận hối lộ, tội đưa hối lộ) thì phân biệt như sau: 6.1. Nếu giá trị tài sản bị chiếm đoạt, giá trị của hối lộ dưới mức tối thiểu được hướng dẫn tại các mục 2, 4 và 5 Nghị quyết này thì chỉ áp dụng điểm b khoản 4 Điều luật tương ứng và xử phạt người phạm tội mức án tương xứng với hậu quả đặc biệt nghiêm trọng do tội phạm gây ra. 7. Nghị quyết này đã được Hội đồng Thẩm phán Toà án nhân dân tối cao thông qua ngày 15 tháng 3 năm 2001 và có hiệu lực thi hành kể từ ngày 10 tháng 5 năm 2001. Các hướng dẫn trong Nghị quyết này được áp dụng khi xét xử sơ thẩm, xét xử phúc thẩm, xét xử giám đốc thẩm hoặc tái thẩm đối với người thực hiện hành vi phạm tội trước ngày Nghị quyết này có hiệu lực. Translation - English OFFICE OF THE NATIONAL ASSEMBLY RESOLUTION OF THE SUPREME PEOPLE’S COURT NUMBER 01/2001/NQ/HDTP DATED 15 MARCH 2001 GUIDING THE APPLICATION OF A NUMBER OF PROVISIONS OF ARTICLES 139, 193, 194, 278, 279 AND 289 OF THE PENAL CODE 1999 THE JUDGES' COUNCIL OF THE SUPREME PEOPLE'S COURT Based on Articles 20 and 21 of Law on the organisation of the People’s Court 1992 (amended and supplemented on 28 December 1993 and 28 October 1995) For a correct and uniform application of articles 139, 193, 194, 278, 279 and 289 of the penal code, which was passed by the Vietnam National Assembly on 21 December 1999 and took effect from 01 July 2000; RESOLVED: To provide guidelines on the application of articles 139, 193, 194, 278, 279 and 289 of the penal code which was passed by the Vietnam National Assembly on 21 December 1999 (hereinafter referred to as the Penal Code) as follows: 1. In applying articles 139, 193, 194, 278, 279 and 289 of the penal code to decide the penalty, on general principle the Courts must base themselves on the provisions of the penal code, taking into consideration the nature and extent of the danger posed to society by the acts of offense, the personal records of the offenders, and any circumstances that extenuate or aggravate the penal liability. 2. In applying point a, clause 4, article 139 of the penal code on the offense of appropriating property through swindling, attention needs to be given to the following: 2.1. In the absence of circumstances that aggravate the penal liability (hereinafter referred to as aggravating circumstances) and circumstances that extenuate the penal liability (hereinafter referred to as extenuating circumstances), or in the presence of both aggravating circumstances and extenuating circumstances, but both of which are considered as equal in nature, the offenders shall be penalised with sentences corresponding to the value of the property appropriated as follows: a. Sentenced to between 12 years and 20 years of imprisonment if the property appropriated is valued between five hundred million dongs and under one billion five hundred million dongs. b. Sentenced to life imprisonment if the property appropriated is valued between one billion five hundred million dongs and under four billion five hundred million dongs. c. Sentenced to capital punishment if the property appropriated is valued at four billion five hundred million dongs or higher. 2.2. In the presence of many extenuating circumstances and no aggravating circumstances or fewer aggravating circumstances, and at the same time a judgment is reached from considering the extenuating circumstances and aggravating circumstances that the penal liability of the offenders may be extenuated, the offenders may be penalised with sentences lighter than those specified at subclause 2.1. of this clause 2 as follows: a. Sentenced to between seven years and under twelve years of imprisonment if the property appropriated is valued between five hundred million dongs and under one billion five hundred million dongs (in this case there must be at least two extenuating circumstances as specified at clause 1, article 46 of the penal code); b. Sentenced to between twelve years and under twenty years of imprisonment if the property appropriated is valued between one billion five hundred million dongs and under four billion five hundred million dongs; c. Sentenced to life imprisonment if the property appropriated is valued at four billion five hundred million dongs or higher. 2.3. In the presence of many aggravating circumstances and no extenuating circumstances or fewer extenuating circumstances, and at the same time a judgment is reached from considering the aggravating circumstances and extenuating circumstances that the penal liability of the offenders needs to be increased, the offenders may be penalised with sentences heavier than those specified at subclause 2.1. of this clause 2 as follows: a. Sentenced to life imprisonment if the property appropriated is valued between five hundred million dongs and under one billion five hundred million dongs; b. Sentenced to capital punishment if the property appropriated is valued at one billion five hundred million dongs or higher. 2.4. In the circumstance that the offenders must be sentenced to capital punishment as per guidelines at subclauses 2.1 and 2.3 of this clause, but the offenders have compensated a significant part in value of the property appropriated (or the relatives or next of kin of the offenders have made such compensation on behalf of the offenders), the offenders may not be subject to capital punishment, and depending on the amount of money compensated the offenders may be subject to life imprisonment of termed imprisonment. In the following circumstances it shall be considered as having compensated a significant part in value of the property appropriated: a. Compensation has been made for at least one half of the value of the property appropriated. b. Compensation has been made for between one third and under one half of the value of the property appropriated if there are bases to prove that the offenders (or the relatives or next of kin of the offenders) have resorted to every measure to compensate the value of the property appropriated (having sold all of their houses or valuable properties; and having endeavoured to borrow…to the highest level). 3. In applying section 4 of article 193 of the penal code on the offense of illegally producing narcotics and section 4 of article 193 of the penal code on the offense of illegally stockpiling, transporting, trading in or appropriating narcotics, attention needs to be given to the followings: 3.1. In the absence of extenuating circumstances and aggravating circumstances or in the presence of both extenuating circumstances and aggravating circumstances, but the extenuating circumstances and aggravating circumstances are considered as equal in nature, the offenders shall be penalised with sentences corresponding to the weight of narcotics involved as follows: a. The offenders shall be sentenced to twenty years of imprisonment in the following circumstances: - Poppy resin, marijuana resin or coca plasma, weighing between five kilograms and under ten kilograms; - Heroine or cocaine weighing between one hundred grams and under three hundred grams; - Marijuana leaves, flower and/or fruit or coca leaves weighing between seventy five kilograms and under two hundred kilograms (applicable for article 194 of the penal code); - Dried poppy fruit weighing between six hundred kilograms and under one thousand five hundred kilograms (applicable for article 194 of the penal code); - Fresh poppy fruit weighing between one hundred and fifty kilograms and under four hundred and fifty kilograms (applicable for article 194 of the penal code); - Other narcotic substances in solid form weighing between three hundred grams and under nine hundred grams; - Other narcotic substances in liquid form measuring between seven hundred and fifty milliliters and under two thousand milliliters; - Involving two or more narcotic substances with their total quantity being equivalent to the quantity of one of the narcotic substances specified in this point (a) with the calculating method specified at subclause 3.2 of this clause 3; b. The offenders shall be sentenced to life imprisonment in the following circumstances: - Poppy resin, marijuana resin or coca plasma, weighing between ten kilograms and under twenty kilograms; - Heroine or cocaine weighing between three hundred grams and under six hundred grams; - Marijuana leaves, flower and/or fruit or coca leaves weighing between two hundred kilograms and under six hundred kilograms (applicable for article 194 of the penal code); - Dried poppy fruit weighing between one thousand five hundred kilograms and under four thousand five hundred kilograms (applicable for article 194 of the penal code); - Fresh poppy fruit weighing between four hundred and fifty kilograms and under one thousand two hundred kilograms (applicable for article 194 of the penal code); - Other narcotic substances in solid form weighing between nine hundred grams and under two thousand five hundred grams; - Other narcotic substances in liquid form measuring between two thousand milliliters and under five thousand milliliters; - Involving two or more narcotic substances with their total quantity being equivalent to the quantity of one of the narcotic substance specified in this point (b) with the calculating method specified at subclause 3.2 of this clause 3; c. The offenders shall be sentenced to capital punishment in the following circumstances: - Poppy resin, marijuana resin or coca plasma, weighing twenty kilograms or more; - Heroine or cocaine weighing six hundred grams or more; - Marijuana leaves, flower and/or fruit or coca leaves weighing six hundred kilograms or more (applicable for article 194 of the penal code); - Dried poppy fruit weighing four thousand five hundred kilograms or more (applicable for article 194 of the penal code); - Fresh poppy fruit weighing one thousand two hundred kilograms or more (applicable for article 194 of the penal code); - Other narcotic substances in solid form weighing two thousand five hundred grams or more; - Other narcotic substances in liquid form measuring five thousand milliliters or more; - Involving two or more narcotic substances with their total quantity being equivalent to the quantity of one of the narcotic substances specified in this point (c) with the calculating method specified at subclause 3.2 of this clause 3; 3.2. The circumstance of “Involving two or more narcotic substances with their total quantity being equivalent to the quantity of the narcotic substance specified in a number of points from…” specified at point đ, clause 4, article 193 and point h, clause 4, article 194 of the penal code shall be considered as follows: a. The first circumstance If all those narcotic substances are specified at the same point of clause 4, article 193 or of clause 4, article 194, the weight of those narcotic substances shall be added up and compared with the weight specified at subclause 3.1 of this clause (3) to consider what penalties the offenders shall be subject to. Example 1: A person produces 9 kilograms of poppy resin and 17 kilograms of marijuana resin. As both poppy resin and marijuana resin are specified at point a, clause 4 of article 193, therefore it’s necessary to add up the weight of poppy resin and marijuana resin, which is totally 26 kilograms (9 kgs 17 kgs = 26 kgs). In comparing this with the weight specified at subclause 3.1 of this clause 3, point (đ) of clause 4, article 193 must be applied to sentence this offender to capital punishment. Example 2: A person trades in 115 grams of heroin and 125 grams of cocaine. As both heroin and cocaine are specified at point b, clause 4 of article 194, therefore the total weight of heroin and cocaine when added up is 240 grams (115 grams 125 grams = 240 grams). In comparing this with the weight specified at subclause 3.1 of this clause 3, point b of clause 4, article 194 must be applied to sentence the offender to 20 years imprisonment. b. The second circumstance If those narcotic substances are specified at various points of clause 2, clause 3, and clause 4 of article 193 or at various points of clause 2, clause 3, and clause 4 of article 194, the method to calculate the weight of these narcotic substances equivalent to the weight of one of the narcotic substances specified at clause 4, article 193 or at clause 4, article 194 shall be executed in the following order: b.1. Take in turn as a standard each narcotic substance among the narcotic substances that the offender has illegally produced, stockpiled, transported, traded in or appropriated. Work out the weight of the remaining narcotics among the narcotics that offender has illegally produced, stockpiled, transported, traded in or appropriated correspond to how many kilograms (grams) or millilitres of the narcotic substance taken in the ratio of minimum weight (quantity) of the remaining narcotics against the minimum weight (quantity) of the narcotic substance taken as a standard specified at clause 4, article 193 or claue 4, article 194 (see examples below). b.2. Add up the calculated weight (quantity) of narcotic substances equivalent to the actual weight (quantity) of the narcotic substance taken as a standard to get the total amount of the narcotics that the offender has illegally produced, stockpiled, transported, traded in or appropriated (calculated as equivalent to the narcotic substance taken as a standard) (see examples below). b.3. Compare the results of the calculation of total quantity of the narcotics that the offender has illegally produced, stockpiled, transported, traded in or appropriated (equivalent to each narcotic taken as a standard) with one another and with the guidelines at 3.1 of this clause 3. If the total quantity of the narcotic substances equivalent to a certain narcotic substance is in favour of the offender in deciding the penalty, that total quantity shall be considered (see examples below). Example: A person trades in 4 kilograms of opium, 90 grams of heroin and 150 grams of the other narcotic substance in solid form. The method for calculating the total quantity of these narcotic substances is as follows: - Firstly: take opium as a standard to work out 90 grams of heroin and 150 grams of other narcotics in solid form are equivalent to how many kilograms of opium (based on the ratio of minimum weight of opium and heroin; of opium and the other narcotic substance in solid form specified at clause 4 of article 194); specifically: * Regarding heroin: 100 grams of heroin is equivalent to 5 kilograms of opium. 90 grams of heroin is equivalent to X kilograms of opium. 90 grams x 5 kilograms X = -------------------------- = 4.5 kilograms of opium 100 grams * Regarding the other narcotic substance in solid form: 300 grams of the other narcotic substance is equivalent to 5 kilograms of opium. 150 grams of the other narcotic substance is equivalent to Y kilograms of opium. 150 grams x 5 kilograms Y = --------------------------- = 2.5 kilograms of opium 300 grams The total weight of heroin and the other narcotic substance in solid form equivalent to opium just worked out (X and Y) and the weight of opium actually involved is: 4.5 kilograms 2.5 kilograms 4 kilograms = 11 kilograms. Accordingly in this circumstance the total quantity of opium, heroin and the other narcotic substance in solid form (the narcotics that the offender illegally trades in) is equivalent to 11 kilograms of opium (1). Secondly: take heroin as a standard to work out 4 kgs of opium and 150 grams of the other narcotic substance in solid form are equivalent to how many grams of heroin (based on the minimum weight of heroin and opium, of heroin and the other narcotic substance in solid form specified at clause 4 of article 194), specifically: * Regarding opium: 5 kilograms of opium is equivalent to 100 grams of heroin 4 kilograms of opium is equivalent to X grams of heroin 4 kilograms x 100 grams X = ---------------------------- = 80 grams of heroin 5 kilograms * Regarding the other narcotic substance in solid form: 300 grams of the other narcotic substance in solid form is equivalent to 100 grams of heroin 150 grams of the other narcotic substance in solid form is equivalent to Y grams of heroin 150 grams x 100 grams Y = --------------------------- = 50 grams heroin 300 grams The total weight of opium and the other narcotic substance in solid form equivalent to heroin just worked out (X and Y) and the weight of heroin actually involved is: 80 grams 50 grams 90 grams = 220 grams Accordingly in this circumstance the total quantity of opium, heroin and the other narcotic substance in solid form (the narcotics that the offender illegally trades in) is equivalent to 220 grams of heroin (2). Thirdly: take the other narcotic substance in solid form as a standard to work out 4 kgs of opium and 90 grams of heroin are equivalent to how many grams of the other narcotic substance in solid form (based on the minimum weight of the other narcotic substance in solid form and opium, of the other narcotic substance in solid form and heroin specified at clause 4 of article 194), specifically: * Regarding opium: 5 kilograms of opium is equivalent to 300 grams of the other narcotic substance in solid form 4 kilograms of opium is equivalent to X grams of the other narcotic substance in solid form 4 kilograms x 300 grams X = --------------------------- = 240 grams of the other narcotic 5 kilograms substance in solid form * Regarding heroin: 100 grams of heroin is equivalent to 300 grams of the other narcotic substance in solid form 90 grams of heroin is equivalent to Y grams of the other narcotic substance in solid form 90 grams x 300 grams Y = ------------------------- = 270 grams of the other narcotic 100 grams substance in solid form The total weight of opium and heroin equivalent to the other narcotic substance in solid form just worked out (X and Y) and the weight of the other narcotic substance in solid form actually involved is: 240 grams 270 grams 150 grams = 660 grams Accordingly in this circumstance the total quantity of opium, heroin and the other narcotic substance in solid form (the narcotics that the offender illegally trades in) is equivalent to 660 grams of the other narcotic substance in solid form (3). - A comparison of results of total determined quantity of equivalent narcotic substances (in accordance with each narcotic substance taken as a standard), which means comparing the results (1), (2), and (3) with one another and with the guidelines at subclause 3.1 of this clause 3 shows the followings: * If the total weight of narcotics equivalent to that of opium (11 kgs) is considered, point h of clause 4, article 194 shall be applied to sentence the offender to life imprisonment (if this does not fall into the circumstances specified at subclauses 3.3 and 3.4 of this clause 3). * If the total weight of narcotics equivalent to that of heroin (220 grams) or equivalent to that of the other narcotic substance in solid form (660 grams) is considered, point h of clause 4, article 194 shall be applied to sentence the offender to 20 years imprisonment (if this does not fall into the circumstances specified at subclauses 3.3 and 3.4 of this clause 3). The above comparison indicates that if consideration is given to the weight of heroin or the weight of the other narcotic substance in solid form, both being equivalent to the total weight of narcotic substances that the offender illegally trades in, it will be in the offender’s favour in both cases; therefore in this example either the weight of heroin or the weight of the other narcotic substance in solid form equivalent to the total weight of narcotic substances may be considered in conducting the trial on the offender. 3.3. In the presence of many extenuating circumstances and no aggravating circumstances or fewer aggravating circumstances, and at the same time a judgment is reached from considering the extenuating circumstances and aggravating circumstances that the penal liability of the offenders may be extenuated, the offenders may be penalised with sentences lighter than those specified at subclause 3.1. of this clause 3 as follows: a. Sentenced to between fifteen years and under twenty years if the weight of narcotic substance falls into point a, subclause 3.1 of this clause 3. (in this case there must be at least two extenuating circumstances as specified at clause 1, article 46 of the penal code); b. Sentenced to life imprisonment if the weight of narcotic substance falls into point c, subclause 3.1 of this clause 3. 3.4. In the presence of many aggravating circumstances and no extenuating circumstances or fewer extenuating circumstances, and at the same time a judgment is reached from considering the aggravating circumstances and extenuating circumstances that the penal liability of the offenders needs to be increased, the offenders may be penalised with sentences heavier than those specified at subclause 3.1. of this clause 3 as follows: a. Sentenced to life imprisonment if the weight of narcotic substance falls into point a, subclause 3.1 of this clause 3 (in this case there must be at least two extenuating circumstances as specified at clause 1, article 46 of the penal code)*; b. Sentenced to capital punishment if the weight of narcotic substance falls into point b, subclause 3.1 of this clause 3. 3.5. In the circumstance that the offenders must be sentenced to capital punishment as per the guidelines at subclauses 3.1 and 3.4 of this clause 3, but if the offenders are only accomplices, committing crimes due to sentimental weakness, coercion or transient greed… which leads to stockpiling and/or transporting narcotics for others, the offenders may not be subject to capital punishment, and depending on each specific circumstance the offenders may be subject to life imprisonment or termed imprisonment. 4. When applying point a, clause 4, article 278 of the penal code on the offense of embezzling property attention needs to be given to the followings: 4.1. In the absence of both extenuating circumstances and aggravating circumstances or in the presence of both extenuating circumstances and aggravating circumstances, but the extenuating circumstances and aggravating circumstances are considered as equal in nature, the offenders shall be penalised with sentences corresponding to the value of the property appropriated as follows: a. Sentenced to twenty years imprisonment if the property appropriated is valued between five hundred million dongs and under one billion dongs; b. Sentenced to life imprisonment if the property appropriated is valued between one billion dongs and under three billion dongs; c. Sentenced to capital punishment if the property appropriated is valued at three billion dongs or higher. 4.2. In the presence of many extenuating circumstances and no aggravating circumstances or fewer aggravating circumstances, and at the same time a judgment is reached from considering the extenuating circumstances and aggravating circumstances that the penal liability of the offenders may be extenuated, the offenders may be penalised with sentences lighter than those specified at subclause 4.1. of this clause 4 as follows: a. Sentenced to between fifteen years and under twenty years of imprisonment if the property appropriated is valued between five hundred million dongs and under one billion dongs (in this case there must be at least two extenuating circumstances as specified at clause 1, article 46 of the penal code); b. Sentenced to twenty years of imprisonment if the property appropriated is valued between one billion dongs and under three billion dongs; c. Sentenced to life imprisonment if the property appropriated is valued at three billion dongs or higher. 4.3. In the presence of many aggravating circumstances and no extenuating circumstances or fewer extenuating circumstances, and at the same time a judgment is reached from considering the aggravating circumstances and extenuating circumstances that the penal liability of the offenders needs to be increased, the offenders may be penalised with sentences heavier than those specified at subclause 2.1. of this clause 4 as follows: a. Sentenced to life imprisonment if the property appropriated is valued between five hundred million dongs and under one billion dongs; b. Sentenced to capital punishment if the property appropriated is valued at one billion dongs or higher. 4.4. In the circumstance that the offenders must be sentenced to capital punishment as per the guidelines at subclauses 4.1 and 4.3 of this clause 4, but the offenders have compensated a significant part in value of the property appropriated (or the relatives or next of kin of the offenders have made such compensation on behalf of the offenders), the offenders may not be subject to capital punishment, and depending on the amount of money compensated the offenders may be subject to life imprisonment of termed imprisonment. It shall be considered as having compensated a significant part in value of the property appropriated in the following circumstances: a. Compensation has been made for at least one half of the value of the property appropriated. b. When applying point a, clause 4, article 279 of the penal code on the offense of accepting bribes and point a, clause 4, article 289 of the penal code on the offense of offering bribes attention needs to be given to the followings: 5.1. In the absence of both extenuating circumstances and aggravating circumstances or in the presence of both extenuating circumstances and aggravating circumstances, but the extenuating circumstances and aggravating circumstances are considered as equal in nature, the offenders shall be penalised with sentences corresponding to the value of the bribes as follows: a. Sentenced to twenty years imprisonment if the bribe has a value between three hundred million dongs and under eight hundred million dongs; b. Sentenced to life imprisonment if the bribe has a value between eight hundred million dongs and under two billion dongs; c. Sentenced to capital punishment if the bribe has a value of two billion dongs or higher. 5.2. In the presence of many extenuating circumstances and no aggravating circumstances or fewer aggravating circumstances, and at the same time a judgment is reached from considering the extenuating circumstances and aggravating circumstances that the penal liability of the offenders may be extenuated, the offenders may be penalised with sentences lighter than those specified at subclause 5.1. of this clause 5 as follows: a. Sentenced to between fifteen years (for the offense of accepting bribes) or between thirteen years (for the offense of offering bribes) and under twenty years of imprisonment if the bribe has a value between three hundred million dongs and under eight hundred million dongs (in this case there must be at least two extenuating circumstances as specified at clause 1, article 46 of the penal code); b. Sentenced to twenty years of imprisonment if the bribe has a value between eight hundred million dongs and under two billion dongs; c. Sentenced to life imprisonment if the bribe has a value of two billion dongs or higher. 5.3. In the presence of many aggravating circumstances and no extenuating circumstances or fewer extenuating circumstances, and at the same time a judgment is reached from considering the aggravating circumstances and extenuating circumstances that the penal liability of the offenders needs to be increased, the offenders may be penalised with sentences heavier than those specified at subclause 5.1. of this clause 5 as follows: a. Sentenced to life imprisonment if the bribe has a value between three hundred million dongs and under eight hundred million dongs; b. Sentenced to capital punishment if the bribe has a value of eight hundred million dongs or higher. 5.4. In the circumstance that the offenders who have accepted bribe must be sentenced to capital punishment as per the guidelines at subclauses 5.1 and 5.3 of this clause 5, but the offenders who have accepted bribe have surrendered a significant part in value of the bribe (or the relatives or next of kin of the offenders have made such surrender on behalf of the offenders), the offenders may not be subject to capital punishment, and depending on the value of the bribe surrendered the offenders may be subject to life imprisonment of termed imprisonment. It shall be considered as having surrendered a significant part in value of the bribe in the following circumstances: a. The value of the bribe surrendered must be at least one half of the value of the bribe accepted; b. The value of the bribe surrendered must be between one third and under one half of the value of the bribe accepted if there are bases to prove that the offenders (or the relatives or next of kin of the offenders) have resorted to every measure to surrender the value of the bribe accepted (having sold all of their houses or valuable properties; and having endeavoured to borrow…to the highest level). 5.5. In the circumstance that the offenders who have offered bribes must be sentenced to capital punishment as per the guidelines at subclauses 5.1 and 5.3 of this clause 5, but the offenders who have offered bribes have been coerced, or have not been coerced but have informed the authorities about the offense before its detection, the offense shall be dealt with as specified at clause 6, article 289 of the penal code. 6. Attention needs to be drawn to the fact that the circumstance as per the guidelines at clause 2 of this resolution is the one in which no particularly serious consequences have been caused; the circumstances as per the guidelines at clauses 4 and 5 of this resolution are circumstances in which no other particularly serious consequences have been caused. In circumstances in which particularly serious consequences have been caused (applicable for the offense of appropriating property through swindling) or in circumstances in which other particularly serious consequences have been caused (applicable for the offense of embezzling, accepting bribes, and offering bribes) the following differentiation shall be made: 6.1. If the value of the property appropriated and the value of the bribe falls into one of the circumstances as per the guidelines at clauses 2, 4, and 5 of this resolution, both points a and b, clause 4 of the corresponding article must be applied. In order to penalise the offenders with a sentence that corresponds to the acts of offense and their consequences, in addition to the implementation in accordance with the guidelines at clauses 2, 4, and 5 of this resolution, consideration needs to be given to the particularly serious consequences caused by the acts of offense. 6.2. If the value of property appropriated or the value of the bribe is under the minimum level as per the guidelines at clauses 2, 4, and 5 of this resolution, only point b, clause 4 of corresponding article shall be applied and the offenders shall be penalised with sentences corresponding to the particularly serious consequences caused by the acts of offense. 7. This resolution was passed by the Judges’ council of the Supreme People’s Court on 15 March 2001 and shall be effective from 10 May 2001. The guidelines in this resolution shall be applied at first-instance trial, appellate trial, cassation procedure, or reopening procedure to the person who committed the acts of offense before the date this resolution becomes effective. In regard to the circumstances in which the offenders have been sentenced in strict accordance with former guiding documents and the judgments have been legally valid, the guidelines in this resolution shall not be based on for making protests in the order of cassation or reopening procedure.

Source text - English 1) Re-evaluation of sediment transport by DSMP monitoring (2009-2013, Dr L. Koehnken) and field research (WWF) in the frame of the project entitled “DECISION SUPPORT FOR GENERATING SUSTAINABLE HYDROPOWER IN THE MEKONG BASIN : Knowledge of sediment transport and discharges in relation to fluvial geomorphology for detecting the impact of large-scale hydropower projects” funded by FFEM/AFD and co-implemented by MRCS and WWF. • The suspended sediment concentrations at the different stations between Chiang Saen and Kratie range between 200 and 400 mg/l, with higher values associated with the onset of wet season; • The suspended load increases to downstream despite some low values due to deposition and low energy inducing sand transported as bedload. For the period 2009-2013 with contrasted hydrological situations, the suspended sediment load averages 10.8 Mt/yr at Chiang Saen, 22 Mt/yr at LuangPrabang, more than 50 Mt/yr at NakomPhanom, 66 Mt/yr at Pakse and 72 Mt/yr at Kratie. • Sand comprises up to 20% of the suspended load of the river at (Kratie) and is transported as bedload, and also as suspended load during periods of high flow due to higher energy and turbulence. • The bedload is dominated by gravel, pebbles and coarse sand at Chiang Saen, fine and medium sand at NongKhai, and coarse to fine sand at Kratie (3 to 15% of the suspended load at different sites). • Much of the previously described imbalances in the sediment budget of the Mekong may be attributable to sand being transported via different mechanisms in different reaches of the river (Bravard et al., 2014). Transport of sand in suspension is directly related to the energy (unit stream power) available at the reach scale during the flood. The results show that the fine wash load is uniformly transported down the length of the Mekong in the LMB, as is sand as bedload. Sand transport varies between uniform and graded suspension downstream of NongKhai, but is limited to uniform suspension in the river downstream of Stung Treng. The changes in energy are also reflected in bedload transport, where availability of material and low energy limits the transport of cobbles and gravel downstream of NakhonPhanom. • A conservative estimate of sand in suspension and sand transiting as bedload could add 10 to 30 million tons to the common estimate of 145 to 160 million tons of suspended sediment. • The suspended sediment load of the river is presently estimated at 11 Mt/yr compared to 85 Mt/yr at Chiang Saen, and ~72 Mt/yr compared to 160 Mt/yrat Kratie (considered as the official value since 1960). The large decrease is presumably attributable to the capture of sediment in the Lancang Cascade hydropower project and in other tributary dams. China contributes ~16% of sediment in the LMB as compared to about 55% before Lancang reach damming; • The impact of Chinese dams has been seen as an important component in the altered sediment budget. Indeed, they may affect fine suspended load transiting from upstream without deposition before the low lands of Cambodia. However, they have not affected sand transport yet because it is still possible to remove considerable amounts of sand from in-channel landforms in the upper mountain reaches of Laos. The impact of the Lancang dams is probably delayed concerning medium and coarse sand and part of the fine sand (L. Koehnken). • Due to the strong reduction in sediment input from China, tributaries of the LMB provide ~70% of the sediment load. The input averages 17% (12 Mt) between Chiang Saen and LuangPrabang, and 53% between NongKhai and Pakse. • The contribution of the 3S rivers system is estimated at 8.5 Mt/yr; this value is lower than modeled values of ~17 Mt/yr due to sediment trapping in reservoirs; 2) Aggregate extraction • The presence of sand and gravel in river channels is important for the integrity and physical structure of the river channel, underpinning ecological processes and biological productivity. The continued delivery of sand to river deltas is critical for maintenance of the structural stability of delta fronts, and for maintaining the balance between salt water intrusions and river water flows. In addition to the ecological function of sand and gravel, the material are also important contributors to the developing economies of third world countries, providing inexpensive materials for land filling and construction. • Alterations to the sand budget of the Mekong were investigated through a field-based survey of sand and gravel extraction operations to arrive at the first estimates of the quantities of material being removed from the river (Bravard, et al., 2014). • Aggregate extraction in the LMB exceeded 55 Mt in the LMB in 2011/2012 with 90% of the extracted material consisting of sand, and over 80% of the extractions occurring in Cambodia and Vietnam.
