I am translating a judgement and the term "tutela punitiva" ocurred in the text and I am not sure how I should translate it. Any suggestions?

"Conforme salienta o Acórdão do Tribunal da Relação de Lisboa de 29-11-2006 (http://www.dgsi.pt/) a respeito da previsão do mencionado art. 25º “... a atenuação não resulta de uma menor exigência de tutela punitiva face a uma menor potencialidade ofensiva de uma menor quantidade, mas antes a de atribuir menor relevo à menor perigosidade presumida da actividade criminosa, avaliada esta na sua globalidade.
