В настоящем отчете целью и задачей оценки является определение рыночной и ликвидационной стоимостей недвижимого имущества для кредитования под залог.
Определение рыночной стоимости недвижимого имущества производится с учетом всех факторов, существенно влияющих как на рынок недвижимости в целом, так и непосредственно на ценность рассматриваемого объекта.
При оценке рыночной стоимости применяются три классических подхода:
• затратный;
• доходный;
• сравнительный.
Стандарты оценки предписывают использование оценщиком всех трех подходов к оценке или обоснованный отказ от их применения. В силу различных обстоятельств, например, уровня развития рынка данного вида имущества, типичности способов приобретения, степени достоверности и полноты исходных данных доступных для проведения оценки, предпочтение может быть отдано одному (двум) из указанных подходов оценки, так как другие (другой) не обеспечивают достаточной для проведения согласования результатов точности оценки, что является обоснованием отказа от применения подходов (подхода).
В нижеследующих разделах дано краткое описание каждого из указанных подходов.
ЗАТРАТНЫЙ ПОДХОД
Расчет стоимости недвижимости затратным подходом основывается на принципе замещения, который гласит, что благоразумный покупатель не заплатит за объект недвижимости дороже, чем ему обойдется строительство в приемлемые сроки объекта, обладающего равнозначной полезностью.
В рамках настоящей части отчета для расчета рыночной стоимости рассматриваемых улучшений был использован метод определения стоимости на основе объектов-аналогов с использованием укрупненных показателей стоимости строительства объектов-аналогов согласно сборникам из серии «Справочник оценщика», публикуемых «КО-ИНВЕСТ». Более подробно описание затратного подхода и обоснование выбора методов представлено в разделе 10.1 настоящего отчета. Стоимость земельного участка определяется на основе доходного подхода с помощью метода предполагаемого использования (описание метода представлено в разделе 10.4 настоящего отчета).
СРАВНИТЕЛЬНЫЙ МЕТОД
Подход к оценке с точки зрения сравнения продаж основывается на прямом сравнении оцениваемого объекта с другими объектами, которые были проданы или включены в реестр на продажу. Рыночная стоимость имущества определяется ценой, которую заплатит типичный покупатель за аналогичный по качеству и полезности объект.
Сравнительный подход наиболее действенен для объектов недвижимости, по которым имеется достаточное количество информации о недавних сделках купли-продажи. Если такая недвижимость на рынке продаж отсутствует, метод сравнения продаж не применим. Любое отличие условий продажи сравниваемого объекта от типичных рыночных условий на дату оценки должно быть уточнено в анализе. Поэтому при применении подхода сравнения продаж необходимы достоверность и полнота информации.
Translation - English 9. SUBSTANTIATION AND CHOICE OF APPRAISAL APPROACHES AND METHODS
In this report, the appraisal purpose and task is to determine the market and liquidation values of real property for receiving a mortgage loan.
The real property market value is determined with consideration of all factors having a significant influence on both the real estate market in general and directly on the value of the property in question.
Three classic approaches are used for determining the market value of the real property:
cost approach;
income approach;
sales comparison approach.
Appraisal standards provide for an appraiser to use all the three approaches to valuation or for a motivated refusal to apply them. By virtue of different circumstances, for example, the level of development of the market of this property type, typicalness of acquisition methods or a degree of reliability and fullness of input data available for appraisal, preference may be given to one (two) of the mentioned appraisal approaches as the others (other) cannot ensure an appraisal accuracy sufficient for harmonization of results, which constitutes the grounds for the refusal to apply the approaches (approach).
A brief description of each of the mentioned approaches is given in the below sections.
COST APPROACH
Real estate value calculation by the cost approach is based on the principle of substitution saying that a prudent buyer will not pay for a property more than he will pay for construction, within an acceptable time, of a property having an equal utility.
Within this part of the report, the calculation of the market value of the improvements in question employed the value determination method based on similar properties with the use of consolidated indices of construction cost for similar properties in accordance with the “Appraiser’s Guide” book series published by CO-INVEST. A more detailed description of the cost approach and the rationale for choosing the methods are given in Section 10.1 of this report. The value of the land plot was determined on the basis of the income approach with the help of the anticipated use method (the method is described in Section 10.4 of this report).
SALES COMPARISON APPROACH
The approach to valuation from the standpoint of sales comparison is based on the direct comparison of the property subject to appraisal with other properties that have been sold or included in the sale register. The property market value is determined by the price which an average buyer will pay for a property having a similar quality and utility.
The sales comparison approach is most efficient for properties for which there is sufficient information about recent purchase and sale transactions. If such real estate is absent on the sales market, the sales comparison approach is not applicable. Any difference of the conditions of sale of the property being compared from the average market conditions as of the appraisal date must be considered for analysis. Thus, application of the sales comparison approach requires reliability and fullness of information.

Notice is hereby given that the Plaintiffs intent to oppose the application of the Defendants dated 01/01/2017.
The opposition is based on article 3 of the Law on Civil Procedure, articles 21, 29 and 31 of the Law on Courts, the Civil Procedure Rules O.5 rr 1, 2, 9 and 10, O.5A, O.6, O. 16 rr. 1-5, 7, 9, O.39 rr 4, O.48 rr1, 2, 8(1)a.1 a.2. (e) 12 and 13, O.64 rr 1 and 2, the European Regulation 44/2001 articles 1-6, articles 1-8 of the Treaty between the Cypriot Republic and the Union of Soviet Socialist Republics on Legal Assistance in Civil and Criminal Law cases dated 19/01/1984 which was ratified by Law 172/1986, Law 40/1982 articles 1, 2 and 3, the Hague Convention dated 15.11.1965 for service outside the jurisdiction of judicial and extra-judicial documents in civil and commercial cases, articles 5, 10, 11, 15, and on the discretion and inherent powers of the Court.
The specific reasons for the opposition are the following:
1. The service of the Summons and/or notice, is both appropriate and consistent with the Law.
2. The Court has jurisdiction to try this case.
3. There is no precedent for the disputed issues.
4. The legal action is not an abuse of the judicial process, and is the proper procedure for the Plaintiff to assert their rights.
5. The authorization for service outside the jurisdiction included the facts to demonstrate a prima facie case.
6. The principles of forum non convenience do not apply in this case or alternatively Cyprus is the appropriate jurisdiction.
7. The service to Defendants 9 was made pursuant to the Order of the Court and is an appropriate service.
8. The request for service outside the jurisdiction included the proper legal basis.
9. Defendants 9 accepted the jurisdiction of the Court upon filing for appearance without permission for the filing of this application at a later stage and are subsequently prevented from promoting this application.
10. There was no concealment of material facts in the application for service outside the jurisdiction.
11. All conditions for service outside the jurisdiction were met.
12. The service of the Summons and/or the notice and the interim order dated 14.8.2012 was duly conducted.
13. The Defendants were made aware of the procedures in a timely fashion and are represented by attorneys and have the opportunity to present their positions.

1.1. Арендодатель передает и обслуживает, а Арендатор принимает во временное возмездное пользование часть нежилого помещения (далее – "Помещение") общей полезной площадью 20 (двадцать) квадратных метров, расположенного по адресу: [-]
1.2. Арендодатель самостоятельно или с привлечением специализированных лиц осуществляет ежемесячное обслуживание и содержание Объекта, согласно Приложению № 2 к настоящему Договору.
2. Порядок передачи Объекта в аренду и возврата его Арендодателю
2.1. Указанный в п. 1.1 настоящего Договора Объект должен быть передан Арендодателем и принят Арендатором по Акту приема-передачи (далее – Акт), в течение одного дня с момента подписания Сторонами настоящего Договора.
2.2. Передача Объекта (части помещения) в аренду и его возврат Арендодателю осуществляется по Акту, составленному уполномоченными представителями Сторон.

2.1. The Property specified in paragraph 1.1 of this Agreement shall be delivered by the Landlord and accepted by the Tenant against the Delivery and Acceptance Certificate (hereinafter the "Certificate") within one day of the time of signing of this Agreement by the Parties.
2.2. The Property (a portion of the premises) shall be leased out and returned to the Landlord against the Certificate made by authorised representatives of the Parties.
2.3. The use of the Property by the Tenant shall not mislead third parties regarding its ownership and the Tenant's ability and obligation to act on his own behalf.
3. Rights and Obligations of Tenant
3.1. The Tenant shall:

2.8.1. Регулирующие клапаны должны поставляться в комплекте с интеллектуальными позиционерами (4-20 мА с HART-протоколом), редукторами давления с фильтрами, с полностью выполненной пневматической обвязкой, c ответными фланцами, прокладками, шпильками и гайками.
2.8.2. Типы регулирующих клапанов определяются Поставщиками по результатам расчетов и по согласованию с Заказчиком. Конструкция клапанов клеточного типа не допускается.
2.8.3. Регулирующие клапаны должны отвечать следующим требованиям:
- тип привода – мембранный,
- чувствительность (с интеллектуальным позиционером) – не более 0.2%,
- гистерезис (с интеллектуальным позиционером) – не более ± 0.2%,
- диапазон регулирования (с интеллектуальным позиционером) – не менее 50:1.
2.8.4. Требования к электропневматическим позиционерам:
- цифровой, интеллектуальный,
- встроенная энергонезависимая память для сохранения конфигурации и архива,
- выходной сигнал 4… 20 мА с HART-протоколом,
- встроенный ЖК-индикатор,
- местные кнопки управления,
- бесконтактный датчик положения регулирующего органа,
- материал кожуха – анодированный сплав алюминия,
- калибровка автоматическая или ручная,
- встроенный датчик положения с выходным сигналом 4… 20 мА (в обоснованных случаях),

2.8.5. Отсечные клапаны, предпочтительно шаровые или заслонки, должны быть с самоподжимающимся уплотнением, поставляться комплектно с соленоидными вентилями, фильтрами-регуляторами, манометрами, конечными выключателями индукционного типа на крайние положения «открыт»-«закрыт» (2 шт.) с выходным сигналом типа NAMUR, с полностью выполненной пневматической обвязкой, c ответными фланцами, прокладками, шпильками и гайками. Гарантированное количество циклов открывания-закрывания отсечных клапанов должно быть не менее 10 000. В обоснованных случаях допускается применение в качестве отсечной арматуры поворотных заслонок с пневмоприводом.
2.8.6. Для управления шиберами печей, жалюзи воздуходувок и дымососов допускается применение пневмоцилиндров, которые должны поставляться комплектно с интеллектуальными электропневмопозиционерами, фильтрами-регуляторами, манометрами, соленоидными вентилями, конечными выключателями индукционного типа, с полностью выполненной обвязкой и всеми необходимыми механическими узлами для сочленения с рабочим органом.
2.8.7. Питание соленоидных вентилей для управления отсекателями и пневмоцилиндрами должно быть 24 VDC, вид взрывозащиты – взрывонепроницаемая оболочка. Применение в обоснованных случаях питания 220 VDC должно согласовываться с заказчиком.
2.8.8. Байпасы регулирующих клапанов должны быть расположены снизу от исполнительных механизмов.
2.8.9. Конструкция запорной части клапанов должна удовлетворять требованиям по герметичности.
Translation - English 2.8. Requirements for actuating mechanisms.
2.8.1. Control valves shall come with intelligent positioners (4-20 mA, HART), pressure-reducing regulators with filters, pressure gages, completely installed air tubing, counterflanges, gaskets, studs and nuts.
2.8.2. The types of control valves shall be determined by the Vendors based on the results of calculations and as agreed with the Customer. Valves may not have a cage-type design.
2.8.3. Control valves shall comply with the following requirements:
- actuator type – diaphragm,
- sensitivity (with an intelligent positioner) – max ± 0.2%,
- hysteresis (with an intelligent positioner) – min 50:1.
2.8.4. Requirements for electropneumatic positioners:
- digital, intelligent,
- built-in non-volatile memory for configuration and archive storage,
- 4 …20 mA HART output signal,
- built-in LCD indicator,
- local control buttons,
- regulator position proximity sensor,
- valve shell – anodized aluminium alloy,
- automatic or manual calibration,
- built-in position sensor with 4 …20 mA output signal (when appropriate),
- built-in inductive limit switches with NAMUR output signal (when appropriate),
- online diagnostic monitoring: total stem stroke length, number of valve cycles, predicted maintenance data …,
- at least IP65,
- intrinsically safe design.
2.8.5. Shut-off valves, preferably ball or gate valves, shall have a self-tightening seal and come with solenoid valves, filter regulators, pressure gages, open/closed inductive limit switches (2 pcs) with NAMUR output signal, complete with air tubing, with counter flanges, gaskets, studs and nuts. The guaranteed number of opening/closing cycles of shut-off valves shall be not less than 10,000 cycles. When appropriate, air-operated butterfly valves may be used as a shut-off valve.
2.8.6. In order to control dampers of furnaces, or louvers of air blowers and smoke exhausters, it is permitted to use air actuators that shall come with electropneumatic positioners, filter regulators, pressure gages, solenoid valves, inductive limit switches, complete with tubing and all mechanical components for connection with the actuator.
2.8.7. Solenoid valves to control shut-off valves and air actuators shall be supplied with 24 VDC, and the type of explosion protection shall be an explosion-proof casing. The use of 220 VDC, when appropriate, shall be agreed with the customer.
2.8.8. Bypasses of control valves shall be located below actuating mechanisms.
2.8.9. The valve closure member shall be designed to comply with leak tightness requirements.
