About the translation of "procede"...

--"proceder": in the latter senses, this verb is used impersonally in the third person singular ("procede"), and it is often translatable by an English modal, such as "should" or "must"-- (Diccionario de términos jurídicos de E. Alcaraz)

that the complaint be dismissed...

Instead of a 'should' or 'must', in my experience the best way to render 'procede' in Span. legal language is through the subjunctive.

"It is the opinion of this court that ... the plaintiff's complaint be dismissed. ..." (http://tx.findacase.com/research/wfrmDocViewer.aspx/xq/fac.1...

"That in the light of the foregoing, it is the opinion of the undersigned that ... the complaint be dismissed with prejudice, and for such other reliefs ..." (http://www.lawphil.net/judjuris/juri1982/jul1982/gr_l_34840_...
