Please provide a reference in Arabic that differentiates between ‘actual/tangible damage." هناك الضرر المادي أم الضرر الآخر غير واضح

If the amount of damages was not agreed by contract or by law, it shall be determined by the judge based on the ‘actual/tangible damage’ or loss of ‘incontestable gain’ suffered by the obligee, provided that such is a natural consequence of non-performance or delay in performance of the obligation

في حالة عدم تحديد مبلغ التعويض عن الأضرار في العقد أو بموجب القانون، فإنه ينبغي تحديده من قبل القاضي استنادًا إلى "الضرر .... " أو فقدان فرصة الكسب الفائت" الذي يعاني منه المضرور، شريطة أن يكون ذلك نتيجة طبيعية لعدم الأداء أو تأخير ....

"Actual" means that the damage already occurred. For example, in insurance, coverage is triggered when the damage actually occurs, regardless of when it is discovered.

"Tangible" means that the damage has a monetary value as opposed to "intangible damages, such as pain and suffering, which do not have a specific monetary value.

Actual damages come in two categories: economic and non-economic.
