Como elementos subjetivos, o crime exige o dolo, isto é, o conhecimento e vontade por parte do agente de praticar alguma das condutas tipificadas, demonstrando com a sua execução, uma atitude pessoal contrária ou indiferente ao dever-ser jurídico penal verificando-se, deste modo, a chamada congruência entre o elemento subjetivo e os elementos objetivos do crime.
Perscrutando a matéria de facto considerada, constata-se que o arguido agiu dolosamente pois ao prever e desejar a produção de tal resultado, decidindo-se pela prática dos factos adequados a provocá-lo, agiu com dolo direto (cfr. art.° 14.°, n.º 1, do CP.), demonstrando uma atitude que, sendo contrária relativamente ao dever ser jurídico-penal, já que podia e devia ter agido de outro modo.
