A tenant in common does not possess a right of survivorship
The tenant-in-common has an undivided share and interest in the property. He has an equal right to the possession of whole of the property but not a right to possess any part exclusively. A tenant-in-common may deal with his share of the property as he or she sees fit. A tenant-in-common may also hold unequal shares in property and therefore if no share is stated then the presumption is equal shares, that are 50/50.

Suvlasnički dijelovi
Članak 36.
(1) Ako više osoba ima neku stvar u svome vlasništvu tako da svakoj pripada po dio toga prava vlasništva, računski određen razmjerom prema cijelom pravu vlasništva te stvari, sve su one suvlasnici te stvari, a dijelovi prava vlasništva koji im pripadaju njihovi su suvlasnički dijelovi.
(2) U sumnji koliki su suvlasnički dijelovi, smatra se da su jednaki.
Članak 37.
… (5) Suvlasnik smije samostalno pravno raspolagati svojim idealnim dijelom stvari, odnosno svojim suvlasničkim dijelom po pravilima koja vrijede za vlasnikova pravna raspolaganja stvarima ako time ne dira u tuđa prava. Kad suvlasnik prodaje svoj dio, ostali suvlasnici nemaju pravo prvokupa, osim ako im to pravo pripada na posebnom pravnom temelju.

All the joint tenants must acquire their interest in the property at the same time and from the same transaction.
The interest must be identical in nature and each tenant enjoys an equal right to the whole or any part of the property but not an exclusive right to possess any part.

Članak 57.
(1) Stvar je u zajedničkom vlasništvu kad na nepodijeljenoj stvari postoji vlasništvo dviju ili više osoba (zajedničara) koje sve u njemu imaju udjela, ali veličina njihovih udjela nije određena, bez obzira na to što je odrediva.
(2) Stvar može biti u zajedničkom vlasništvu samo na temelju zakona.
(3) Kad je stvar na temelju zakona u zajedničkom vlasništvu dvaju ili više zajedničara, nema utjecaja na to činjenica da je u zemljišnim knjigama ili bilo gdje drugdje prikazana kao vlasništvo samo nekoga od njih, osim prema trećim osobama čije se povjerenje u prometu štiti.
(4) U sumnji sudjeluju li osobe u suvlasništvu ili zajedničkom vlasništvu neke stvari, smatra se da je to suvlasništvo.

Explanation:
A tenancy in common - a misnomer by 'rights' and that catches out many translators anmd interprters, including professionally negligent UK translation agencies that (ignorantly) used to edit my separate title translation of tenancy-in-common to a joint tenancy - is archaic Anglo-American land & other moveable property law for separate ownership e.g. of land, chattels & bank accounts that can be willed passed separately by the owner to any beneficiarz wanted.

Joint tenancy is 'survivorship' by jus or ius accrescendi. Title (of the notional or 'ideal' one half, in some legal systems the whole estate) passes automatically on death to the survivor.

Now we know why most Anglo-Am. & Aujssie-NZ etc. law students fail the land law examination paper the first time round !

I carve indulgence for little knowledge of Hvratsky, depsite a conference visit to Zagreb and many Croatian neighbours in Vienna and London.

neutral  Daryo: I don't have time to check it, but AFAIK there is nothing comparable to "ideal parts automatically passing to the survivor" in Croatian law. EACH "ideal part" is inherited separately according to the will or general inheritance rules. Very tricky term.

agree  Vesna Maširević: Mislim da to nije adekvatan termin, jer zakup ne podrazumeva vlasništvo. Doduše, bilo bi bolje da sam i ja postavila Ref. umesto odgovora, jer je problematika dosta složena.
