Bus/Financial - Finance (general) / Portuguese deed of sale detailing mortgage conditions
This sentence appears in a deed of sale relating to a property in Portugal. The deed includes a section relating to the mortgage-backed loan granted in order to make the purchase. I found the translation for beneficio de excussao previa on here already, but cannot find anything for this term. All help gratefully received. Thanks in advance.

Here's one more example sentence:

"One of such creditors, who is at the same time a debtor of his debtor, but whose debt is not yet exigible, cannot, by renouncing the benefit of the term by which the debt to him is not yet due, and by asserting a set-off, acquire such a preference." https://books.google.com/books?id=T2qmAAAAIAAJ&pg=RA1-PT39&l...

I guess it doesn't hurt to provide more evidence that "term" is the correct translation of "prazo" in this particular context.

prazo: 2 – (dir. material) term. “At A’s option, the contract may be renewable
for a second five year term”. [Hamilton, Robert W., The Law of Corporations, p. 355]. In: "Dictionary of Law, Economics and Accounting", 4th edition, by Marcílio Moreira de Castro, Editora Forense, p. 315.

Heather, I'm glad to hear that the literal translation was a good fit. Unfortunately, some folks on ProZ have the wrong notion that literal is never good. :-)

renunciar desde já e expressamente benefício do prazo
hereby waive the > right to redeem (mortgage) witihin the term date > Anglo-Am. equity of redemption

Explanation:
Methinks the construction needs to be viewed as a whole and 'holistic waiver'.

Otherwise, there's a similar SPA/ENG question with familiar respondents' names. As in that question, I'm unsure it's all about the option to pay by insta(l)lments.

If the benefit of the mortgage as a demise for a *term of years* is waived, then the 'term of the mortgage loan is accelerated'. Likewide, at our Iberian law office, 'renunciando desde já e expressamente ao benefício de excussão prévia' had been rendered in Anglo-Am. shorthand as 'expressly accepting primary libaility'. -> 'guarantor's right to force a creditor to sue the principal debtor first', West Mex. etc. SPA/AmE.

Example sentence(s):
  • IATE: 1683127 1 FINANCE COM en equity of redemption COM pt direito de resgate COM
  • Equity of redemption (also termed right of redemption or equitable right of redemption) is a defaulting mortgagor's right to prevent foreclosure proceedings ..

benefit of term, term benefi

Explanation:

"...expressly waiving the benefit of prior excussion, as well as the benefit of term provided for in Article 782 of the Civil Code..."

Prazo da prestação

Artigo 777.º
(Determinação do prazo)

Artigo 779.º
(Beneficiário do prazo)

Artigo 780.º
(Perda do benefício do prazo)
